Privacy Policy

SecureGuide INC. (“SecureGuide”) is committed to providing every customer with great service and considers the protection of the personal information of each customer (including potential customers) to be a key part of its high level of service. At SecureGuide, providing a private and secure purchasing environment is one of our top priorities and we want you to be as comfortable and at ease as possible when downloading our application. This Privacy Policy explains how we collect your personal information on our application and/or when you use any of our web-based services, how we use, disclose, protect and otherwise manage such information, and the choices you have concerning the collection, use and disclosure of such information.  

Please read this Privacy Policy carefully.  

“Personal information” is information about an identifiable individual, which includes information that can be used on its own or in combination with other information to identify, contact or locate a specific individual. This includes your name, email address, mailing address, telephone number, credit card number and the like. Please remember that this Privacy Policy applies only to information collected by our application or through our web-based services. We are not responsible for the privacy of any information you reveal or choose to post in any public forum or for the privacy practices of applications that are operated or owned by third parties. Additionally, personal information does not include de-identified or aggregated information that cannot reasonably be associated with a specific individual, or any other information excluded by applicable law. 

 

Consent  

Your knowledge and consent are required for the collection, use or disclosure of your personal information. By using the services made available on SecureGuide’s application, you consent to the collection and use of your personal information for the purposes listed below as well as the disclosure of such information in accordance with this Privacy Policy. You may refuse or withdraw your consent at any time subject to any legal and contractual restrictions and reasonable notice; however if you make this choice we may not be able to provide you with the product, service or information that you requested or that could be offered to you. If you withdraw your consent we will inform you of the implications of such withdrawal. To withdraw your consent, please contact our privacy department at the address provided below and advise the privacy department of what personal information you no longer wish us to collect, use or disclose. 

 

In addition, if you wish to opt-out of marketing or promotional communications in the form of emails or text messages from us, you can opt-out by following the unsubscribe instructions included in any such message or by contacting us using the address provided below. Please note that even if you opt-out of electronic marketing or promotional communications, we may still contact you with important transactional or administrative information about your account. 

What Personal Information We Collect 

We may collect some or all the following personal information through our application and/or application: 

  • Information establishing your identity and contact information, such as your name, telephone number, and email address; 

  • Credit card information and transaction information, such as cardholder name, card number, account balance and transaction history; 

  • Information to authenticate your identity, such as email address and password that you enter to log into your account or register your card on our application and your Internet Protocol (IP) address; 

  • Information you provide during interactions with us, whether online, by phone, in writing or otherwise, such as when you contact our customer services or receive customer support, which information may include feedback, opinions and issues you may have encountered; and 

  • Other personal information with your consent or as permitted or required by applicable law. 

We may also collect non-personal information that does not directly or indirectly reveal your identity or directly relate to an identified individual, such as statistical or aggregated information, to help us understand the interests of our customers, cardholders and users, to improve our application, products and services, and to manage our risks and operations. 

Limitation on Collection 

We will not collect any personal information from you unless you voluntarily submit such information to us. Therefore, if you do not want us to obtain any personal information about you, do not voluntarily submit such information to us. We follow the practices which we in good faith believe are generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially reasonable means to protect your personal information, we do not guarantee its absolute security. 

 

We will limit our collection of your personal information to only those details necessary to fulfill the purposes for which it was collected, unless you have otherwise consented. 

Reasons for Collection and Use of Personal Information

SecureGuide collects personal information about its customers, and in some cases potential customers, primarily for the following purposes: 

  • to provide you with the correct recommendations and support based on the responses you provide us; 

  • to process payments; 

  • to invite customer/subscribers to participate in s surveys or other opinion-gathering; 

  • to operate and update devices that assists us in making our service more responsive to your needs; and 

  • to keep customer/subscriber informed of various matters about our products and services which we believe will be of interest. 

From time to time, we may combine your personal information with that of other individuals to create aggregate data that can no longer reasonably be associated with an identifiable individual, which we will use, for example, but without limitation, to do research, analyze usage trends and generate reports to improve our products and services. 

As part of SecureGuide’s commitment to maintaining the accuracy, confidentiality, and security of your personal information we have adopted the personal information privacy principles stated in the Canadian Standards Association (CSA) Model Code for the Protection of Personal Information. These principles form part of the Personal Information Protection and Electronic Documents Act, which establishes rules governing the collection, use and disclosure of Personal Information by the private sector. 

How We Share Your Personal Information 

We may share your personal information: 

  • with our affiliates and subsidiaries for the purposes described in this policy; 

  • with business partners, contractors, service providers, and other third parties that support the operation of our business or assist us in providing our products and services, such as those that provide or assist with payment processing, identification and verification services, customer service, application hosting, information technology services, email delivery, data analysis, and other similar services, but only as necessary for such purposes. We require those third parties to keep your personal information confidential, to use it only for the purposes for which we disclose it to them, and to protect the personal information in a manner consistent with the standards set out in this policy and in accordance with applicable law; 

  • to comply with any subpoena, court order, lawful request, or legal process, including to respond to any government or regulatory request, in accordance with applicable law; 

  • to protect against, detect, suppress, investigate, and/or take action regarding suspected or actual financial abuse, fraud, or other harmful, unauthorized or illegal activity; 

  • in accordance with applicable law, in connection with, or during negotiation of, any merger, amalgamation, financing, securitization, or sale or other disposition of some or all of our business assets to another organization; 

  • to enforce our rights, including our terms and conditions that govern our products and services; 

  • to protect our property, or protect the rights, property or safety of you or others; 

  • for any other purpose disclosed by us when you provided the information; 

  • with your consent or as permitted or required by applicable law. 

Limiting Use, Disclosure and Retention 

Except as set forth in this Privacy Policy (including under the heading “How We Share Your Personal Information” above) or as specifically agreed to you by you, we will not disclose any personal information we gather from you on our application and web-based services. We will only retain your personal information as long as is necessary for the fulfillment of the purposes for which it was collected or as permitted or required by law, after which it will be destroyed or made anonymous, such that it can no longer reasonably be associated with you. We reserve the right to use and disclose such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent. 

Storing, Processing and Transferring Your Personal Information 

Your personal information may be stored or processed in Canada and other countries, whose privacy or data protection laws may or may not be equivalent to Canadian law. If your personal information is transferred to a country outside of Canada, we will take reasonable measures to protect your personal information with appropriate security safeguards, however, in such circumstances, the governments, courts, law enforcement and/or regulatory agencies of any such country may be able to obtain access to your personal information through the laws of that country. 

Storing, Processing and Transferring Your Personal Information 

When you access or use our application, we may use cookies or other automatic data collection technologies to collect certain information about your device, browsing actions, and patterns, including: 

  • details of your visits to our application, including traffic data, location data, logs, and other communication data and the resources that you access and use on the application; and 

  • information about your device and internet connection, including your IP address, operating system, and browser type. 

Cookies are small text files that applications send to your device to uniquely identify your browser or to store information or settings in your browser. Cookies allow us to recognize you when you return and help us provide a customized experience. In many cases, you can manage cookie preferences and opt-out of having cookies and other data collection technologies used by adjusting the settings on your browser. All browsers are different, so visit the “help” section of your browser to learn about cookie preferences and other privacy settings that may be available. Please note that if you choose to remove or reject cookies, this could affect some of the features, availability, and functionality of our application. 

We may use cookies to conduct marketing and promotional efforts, tailor certain advertisements to your browser that we think may be of interest to you, or to determine the popularity of certain content on our application. 

Accuracy of Personal Information 

We will maintain all personal information in our possession in as accurate, complete, and up-to-date form as is necessary for the purposes for which it is to be used. To help us keep your personal information up to date, we encourage you to notify us of inaccuracies or corrections as often as you wish. Any notification of change or request for correction must be made in writing to our privacy department at the address below. 

Safeguards 

We will use commercially reasonable efforts to protect your personal information from unauthorized access, use, alteration, duplication, destruction, or disclosure by employing safeguards that are appropriate to the sensitivity of the information. We follow the practices which we, in good faith, believe are generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially reasonable means to protect your personal information, we do not guarantee its absolute security. Our PCI/CISP certified Webstore uses SSL or “Secure Sockets Layer”,” an industry standard security protocol. When you are asked for certain personal information (such as a credit card number), SSL encrypts it so that no one can read it while it is being transmitted over the Internet. Other information (such as your business name, client number where applicable, and address) is safely stored behind a firewall. A firewall is a set of related programs that protects your information from users from other networks. We store this type of information so that you do not have to re-enter it each time you make a purchase or log in. 

In addition, only those employees or agents who need to access your personal information to perform a specific task or function are granted access to such information. All employees and/or agents must abide by this Privacy Policy and are trained and kept updated on our security practices. Any employee who violates this Privacy Policy is subject to disciplinary action, up to and including termination.

Openness and Access 

Information about our policies and practices relating to the management of personal information will be made readily available to you on our application and upon request. 

At your written request, we will inform you of the existence, use and disclosure of your personal information in our possession or control and will provide you with any access to that information. We may require specific information from you to help us confirm your identity and respond to your request. Applicable law may allow or require us to refuse to provide you with access to some or all your personal information, or we may have destroyed, erased, or made your personal information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions. All requests for personal information records and/or questions and concerns about the privacy of your personal information should be directed to SecureGuide’s privacy department by mail at the address below. 

Links to Third Party Applications 

Our application may include links to third-party applications, plug-ins, services, social networks, or applications that we do not manage or control and that are not governed by this policy. Clicking on those links or enabling those connections may allow the third party to collect or share data about you. You should familiarize yourself with the privacy policies and practices of any such third party before providing them with your personal information. We do not accept any responsibility or liability for any such third party’s policies or information practices. 

Minors 

Our application and related products and services are not intended for children under 13 years of age. We do not intentionally collect personal information from children under 13. If you are under the age of 13, please do not use our application or related products or services. If you are over the age of 13 but under the age of majority in the province in which you reside, you should use our products and services with the involvement and permission of a parent or legal guardian. If we learn we have collected or received personal information from a child under 13 without verification of parental or legal guardian consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us using the address provided below. 

Changes to this Privacy Policy 

We may update or make changes to this policy from time to time. If we make any material changes, we will post the revised policy on the application and we will update the effective date at the top of the policy. We may also notify you of changes by email, through a notice on the application home page and/or any by other legal means. Please check the policy periodically for any updates or changes. Your continued use of the application and/or our related products or services will be subject to the terms of the then-current policy.

SecureGuide is pleased to assist you with the resolution of a privacy complaint. We will investigate and respond to your inquiries or requests and attempt to resolve any complaints regarding our privacy practices.
